Florida Medical Marijuana Daily Dose Limits: What Patients Need to Know
Florida law places strict limits on how much medical marijuana a qualified patient can be certified for by their physician. The Medical Marijuana Treatment Center (MMTC) is prevented from exceeding these limit by their dispensing software, which is integrated with the state’s system. Understanding these rules can help patients plan their purchases and help MMTCs communicate with patients effectively and stay compliant.
Physician Certification Limits
Under section 381.986, Florida Statutes, a qualified physician may not certify more than:
Three 70-day supply limits for marijuana in non-smoking forms.
Six 35-day supply limits for marijuana in a form for smoking.
The physician certification also specifies which routes of administration patients are allowed to purchase. For example, your order might allow oral capsules, edibles, or inhalation products — but not all three. You can only buy products in the categories listed on your active certification.
MMTC Dispensing Limits
Florida MMTCs must follow strict dispensing caps:
No more than a 70-day supply of marijuana (non-smoking form) within any 70-day period.
No more than one 35-day supply of marijuana in a form for smoking within any 35-day period.
A 35-day smoking supply may not exceed 2.5 ounces, unless an upward exception is approved by the Florida Department of Health.
Important: Some MMTCs classify the same product under different or multiple routes of administration. This means a cannabis oil product might count toward your “inhalation” limit at one MMTC but towards “sublingual” at another. Always check with the MMTC you are purchasing from so you know exactly how the product will be counted against your limits.
Daily Dose Limits by Route of Administration
Florida’s Emergency Rule 64ER22-8 sets daily dose limits and their corresponding 70-day supply caps:
An aggregate 70-day supply limit for all non-smoking marijuana forms may not exceed 24,500 mg of THC.
Rolling 70- and 35-Day Calculations
The limits are rolling, not calendar-based:
For non-smoking products, MMTCs look back 70 days from the date of each sale.
For smokable products, they look back 35 days.
This means your available balance changes daily based on past purchases.
The Role of the Medical Marijuana Use Registry
Every certification and purchase is recorded in Florida’s Medical Marijuana Use Registry — a statewide database that:
Tracks your active physician certifications.
Monitors how much you’ve purchased in each route of administration and when the purchase was made.
Prevents sales that would put you over your legal limit.
Before any sale, MMTC staff must check the registry to confirm that the transaction will not exceed your limits. MMTCs will also ask for your photo ID to ensure they are dispensing to the correct patient (OMMU inspectors will check written records and surveillance camera footage when a question arises about whether a product was incorrectly dispensed).
Exceptions to the Limits
In certain medical circumstances, a physician can submit a Request for Exception to the Florida Department of Health for:
Higher daily doses for non-smoking products.
Larger 35-day smoking limits.
Higher possession limits for smokable marijuana.
The Department must approve or deny the request within 14 days. If approved, the exception can remain valid for the duration of your physician certification (up to 210 days).
